SCOPE / GENERAL

TLAKO GmbH (referred to as TLAKO GmbH) is based in Zug and runs and sells the goods specified in the online shop.
The delivery area is restricted to the territories of Switzerland and the Principality of Liechtenstein. The following terms and conditions apply to all steps in the purchasing process, which occur via the online shop, particularly the registration and storage of customer data, delivery, payment, customer service, and omplaints, the use of customer data copyright, and trademark rights.
Customer Data usage: The Privacy Policy covers the use of customer data. Specific reference is made to the Privacy Policy, which forms an integral part of the GTCs.

INTELlECTUAL PROPERTY

Tlako GmbH reserves all rights for every design, image, and text on print and online media. The name, trademarks, product names, company logos, and online content is property of their respective owners. Copying or any other reproduction of part or the entire print and/or online media is only permitted with written consent from TLAKO GmbH and their respective owners.

REGISTRATION

Only legally competent persons may register for an account in the online shop. To place an order as a registered member, customers must identify themselves in the online shop with their e-mail address and password.
If the customer is placing an order as a subscription in the online shop, they will be asked to set up a user account and provide the necessary customer data. The data required for registration must be complete and accurate. The customer is responsible for keeping up to date their data. Registration is free. There is no entitlement to admission to the online shop.
The customer undertakes to protect access to their user account and not divulge the account’s password to third parties.
An informative e-mail may be sent to the e-mail address indicated during the registration process several times a year, containing the latest news or special promotions. The customer can unsubscribe from this e-mail at any time by clicking on the appropriate link in the footer at the bottom of the e-mail.

ORDERING

Product range: The information published in the online shop is regularly updated, with the utmost care. In exceptional cases, errors in the description, illustration, and/or price information may occur. In such an instance, the information on the packaging takes precedence. Periodic description, illustration, packaging and/or price changes are reserved.
Order placement: By submitting an order, the customer expressly agrees to the GTCs. The order is binding on the customer when they complete the online ordering process by clicking the “Submit order” confirmation button. The customer confirms the information’s accuracy and makes a binding offer to purchase the products ordered by clicking the confirmation button. The customer receives a confirmation e-mail of the order after completing the order process. This confirmation e-mail constitutes acceptance of the offer by TLAKO GmbH. No contractual relationship exists between the customer and TLAKO GmbH until this confirmation has been sent.
The customer has no entitlement to acceptance of their order. TLAKO GmbH may decide not to accept an order and refuse to confirm it.
Amending and canceling orders: Orders can only be amended if the customer has not yet clicked the “Submit order” confirmation button to complete the ordering process. Once the customer has clicked the confirmation button, the customer can no longer amend the order.
The customer may cancel orders confirmed by TLAKO GmbH, provided they do so at least before the following Monday at 10h00 AM CET (cutoff period to roast the coffee ordered) after the order confirmation. For example, an order placed on a Wednesday can be canceled up to the following Monday at 10h00 AM CET before the roasting process begins.
The customer must contact Customer Service if they wish to cancel the order. Cancellation is only valid if confirmed by Customer Service. Customer service can be reached as follows: contact (link).
Guarantee of data communication: Given the current state of the art, no assurance can be provided that data communication via the internet will be error-free and/or available at any time. TLAKO GmbH, therefore, accepts no liability in respect to the constant, uninterrupted availability of the online shop, nor for technical and electronic faults during the ordering process, in particular for any delay in processing or accepting orders.

DELIVERY, COMPLAINTS, REFUNDS, AND WARRANTY

Delivery area and date: Our products shipping takes place within Switzerland and the Principality of Lichtenstein. We do not deliver abroad. As a rule, all the coffee is roasted after the ordering process to guarantee freshly roasted beans. The cutting time to order before the roasting process starts is Mondays at 10h00 AM CET. For example, an order made after Monday at 10h00 AM CET will be roasted the following Monday after 10h00 AM CET.
Delivery partners: The delivery is fulfilled by DHL and notifies directly to the customer when the order is ready for dispatch. If the customer is not at home at the delivery time and has made no special instructions, the goods will be deposited in the customer’s mailbox or front door. Once the order has been handed over or the products left, the benefits and risks, particularly the risk of theft, damage by third parties, or environmental factors, pass to the customer.
Delivery cost: The delivery’s cost is CHF 9.90 for up to 27 kg and paid at the time of the purchase. The shipping fee is not included in the item’s price and is charged separately during the check-out process.
Impossibility of delivery: The customer must provide accurate information and adhere to that information. Suppose the customer is in breach of this requirement and the order delivery is not possible, e.g. due to the customer’s address details being incorrect. In that case, TLAKO GmbH is entitled to cancel the order and charge a fixed compensation fee of CHF 50.00 for the inconvenience caused.

Complaints and refund policy: The condition of the goods received must be checked immediately after reception (max. five days after reception). If the complaint is justified, the purchase price will be refunded to the customer. The customer keeps the item. The refund will be made to the payment method used. For some payment methods, the customer will receive a gift card to the value of the refund. A refund with the chosen payment method or reverse payment to the selected payment method is not possible.
Warranty and liability: A reduction or change is excluded. In particular, TLAKO GmbH is not liable for damage that can be traced back to improper use or natural wear and tear or for damage that did not occur on the delivery item itself (consequential damage caused by a defect). If the delivery items are visibly damaged, claims will only be settled against a certificate from the respective delivery partner.

PRICES AND PAYMENT

Prices: All prices are quoted in Swiss francs, including VAT at the applicable rate. The prices are displayed at all times on the online shop at the time of the order.
Payment methods and payment terms: Various payment methods are available: credit card, TWINT, and PostFinance. The payment methods are displayed for selection when the order is finalized.
Payments by invoice: For companies/legal entities, there is the possibility to pay via an invoice, available after written request and approval confirmation. A physical copy of the invoice is included in the delivery, and an e-mail is sent if possible. Otherwise, it is sent to the billing address specified by the customer. Invoices are payable within 30 days of receipt, without deductions or other discounts.
Wrongful deductions will be charged to the customer. Failure to settle an invoice on time incurs a charge of CHF 20.00 plus default interest at a rate of 5% per annum from the due date.
If the customer is late in payment, TLAKO GmbH is entitled to block the customer’s account, mandate a third party to collect outstanding fees, and assign claims to third parties in Switzerland or abroad.
Special offers and gift cards: Special offers are available on the online shop or sent directly to customers with a voucher that clearly states it can be redeemed on the online shop. Only one voucher can be redeemed per order, it must be entered when the order is placed, and it cannot be subsequently credited.
Gift cards can be purchased in the online shop and redeemed with a code. Only one gift card can be redeemed per order, and the code must be entered when the order is placed. If the value of the order is below the value of the voucher, the remaining balance is forfeited.

FINAL PROVISIONS

Contradictions between different language versions: In the event of contradictions between the English, German, and/or French texts, the English version shall be authoritative.
Changes to GTC: TLAKO GmbH reserves the right to revise these GTC at any time. Changes will be notified on the online shop and take effect when they are published. The customer accepts the new provisions when ordering after the publication of the new GTC.
Severability clause: Should any provision of these GTC prove to be unenforceable or invalid, the validity of the remaining provisions shall remain unaffected.
Applicable law and jurisdiction: Swiss law is solely applicable. The place of jurisdiction for natural persons and/or legal entities is Canton Zug.
